Kim Armstrong Paralyzed by a DUI Driver

Kim’s family members were hoping to get more news coverage to follow up on her story, but that did not happen. They believe that Channel 24 did not have the facts correct. They wanted to get the message out that the driver was never arrested and the court date that was reported on the news was from a previous DUI charge from last year not from this accident that took place on November 14th, 2010 that left Kim paralyzed.

Driver is a Repeat Offender

According to family members, the driver was driving on a suspended DUI license and on probation in Tennessee at the time of the accident. After the accident, the drunk driver was taken to the hospital and was released from the hospital and never arrested. Some of the nurses at the hospital mentioned that they recognized the driver because he was admitted at the same hospital several times in the past several months due to drug and alcohol issues. The nurses also mentioned that after they did his blood test they found traces of alcohol and pain killers in his system. The driver also has a long history of DUIs, drug and accident charges on his record, in addition to 2 DUIs charges within the last 18 months that all happened within 3 months apart for each other in Tennessee. The report showed that in one of his previous charges, someone was injured. According to the reports, the driver has been arrested 7 times for drug, alcohol and vehicle related incidents and one arrest for carrying a loaded handgun while under the influence of drugs in a Wal-Mart dressing room.

Driver Received 2 Tickets but was Never Arrested at the Hospital

The drunk driver only received tickets for the incident and was never arrested. One of the tickets was for driving on a suspended DUI license and the second ticket was for driving without car insurance. Kim’s family later realized that the hospital refused to call the police because the police would be responsible for paying the drunk driver hospital bill. This is what a family member said, “How screwed up is that! It’s sad – criminals have more rights than the victims! Is that what we call justice?

Kim Family members are not happy with the situation and said:

My sister’s life has been changed forever and hundreds of thousands of dollars if not millions of dollars in medical expenses. Her rehab is going to be $3,500 a day – and she will need at least 6 months or more of rehab all because of this guy. I am sure this guy is still out driving around popping pills and drinking! I guess you have to kill someone to get arrested these days and then you’ll probably will only spend 5 years in jail! No wonder there is some much crime today, criminals can get off easier. The police told us they have to be careful about arresting him because they can get sued?!?! I never realized how screwed up our justice system is and I hope no one never ever has to go through what we are going through” Said family members. They are shocked that this guy is not in jail – they want justice for Kim.

How Citizens Can Help Police Control Drunk Driving?

Drunken driving menace has grown over the years inspite of growing DWI legislations and regulations to curtail the very act of drinking while driving. The most threatening ones are underage drinking, teenage drunk driving and the mother of all the alcohol abuse.

People found drinking and driving are subjected to a number of Field Sobriety Tests such as Breathalyzer, Blood Alcohol Content (BAC) and certain other on the spot test and convicted under DWI offense under the driving laws of the state once they are found crossing permissible legal limits.

With Zero Tolerance Test and Legal Minimum Drinking Age regulations, underage drinking and teenage drinking and driving is kept under control. But again we cannot be sure about how long such regulations stand effective.

While it is the duty of the legal system and police to shoulder the responsibility of maintaining law and order in the country, nothing is possible without people’s cooperation and assistance. Unless we help them in pointing out the danger they can hardly help us.

Your Action can Help Police Stop Drunken Driving

An action helping the police get rid of drinking and driving menace is one great thing that can happen provided we individuals understand the meaning and importance of it. It is practically not possible for the law enforcement officials to be everywhere to book people under DWI offense. It is only with the help of responsible and observant drivers and pedestrians who can actually help make roads safe for everyone.

The first thing that you should be noting down is the phone number you should be calling to inform about the intoxicated driving. Call 911 if you happen to see some one weaving on road, swerving, braking abruptly, appears to be heavily intoxicated, stopping without reason on a traffic lane, crossing traffic all of a sudden, responding very slowly to traffic signals, conducting the vehicle rapidly, drifting away, driving on a route other than the designated one, inconsistency in signaling without proper response, taking an unreasonably wide turn, rash driving almost hitting an object or vehicle, taking illegal turns on road.

When you call the enforcement officials make sure you inform them about the whereabouts of the location you are calling from, the direction of your travel, vehicle description and the driving license number on the plate if is possible. Your duty stops in informing the officials and you are no way expected to interfere with the driver or stop him whatsoever. Make sure you do not get into the scene provided you are a victim of any mishap.

Consequences of Drinking and Driving – DWI Offense

Driving laws of the state make it clear that if a person is found driving the vehicle under intoxication and tests reveal intoxication beyond the legally permitted limits then he will be convicted under DWI offense under the DWI laws of the state for alcohol abuse and drunk driving. Depending upon the extent of damage caused and level of intoxication revealed through BAC and other tests the punishment is determined which involves fine, imprisonment and alcohol treatment programs.

Despite repeated warnings and detailed explanations about the seriousness of the issues relating to drinking and driving public hardly seem to take it seriously. People tend to be careless and willingly invite trouble. Unfortunately, innocent travelers on road go to the extent of even loosing their lives or suffer from incurable health issues due to the stupid act of irresponsible few.

Terrifying Journey of a Drunken Driver

It was a long weekend and a group of friends decided to set out for a long trip in their car. All between the age group of 19 to 25, decided to have a blast with drinks. Who just doesn’t love it? So, were they totally excited about the fun.

‘Who can stop us from enjoying life’ saying so they began their journey on a late Wednesday evening. Fear factor just did not find place in their attitude, not even the safety aspect. Once their car set off on a long ride, the driver of the car began drinking. The effect of alcohol was taking its toll on the young alcoholics

They had a long way to drive before reaching their destination. It was an empty road and their excitement was at its height.

After having driven for a while they decided to halt to take rest. Their spiritful mood was shown up with spirits in their hands. Little were they aware of the dangerous journey ahead of them. With irresponsible drinking habits not only are they putting their lives under risk but also the risk of others in the car and on the road.

An hour later they decided to drive the car and reach their destination before it was dawn, completely ignoring the fact that all of them were drunk and are just not in a position to even walk. I wonder how someone can be so careless about their own lives in the first place!

The group did manage driving for a while, how long can somebody withstand the effect of alcoholic drinks, soon the driver of the vehicle lost his control and the car went crashing near a bend against another car coming from opposite direction.

The car toppled after it went crashing against the car coming in the opposite direction. While the driver the car died on the spot others suffered severe injuries. It was a fateful day for Mr. & Mrs. Paul who where travelling in the opposite direction.

In the picture Mrs. Paul who was knocked out of the car suffering from multiple soft tissues injury and SLAP tear. You can also notice a permanent softball size bruise appearing on her right cal muscle due to hematoma.

Here the picture of Mr. Paul with his eyelids sliced through by the car hood which came through the window. The couple had no memory of the actual wreck and according to them it all happening in a matter of seconds. It was later that they came to know that the accident was caused by a group of drunken youngsters who were on their way for an outing.

And for the group of friends, not just everyone suffered severe injuries they also lost one of their friend who was driving the vehicle.
