In Atlanta, GA, drinking and driving is taken very seriously. If you are pulled over you will have to submit to a field sobriety test and breathalyzer test. If you have been charged with DUI, it is important for you to immediately contact a defense attorney. An experienced DUI/DWI attorney can ensure that your rights are upheld during this confusing time.
Drunk Driving First Offense
If you are charged with a DUI first offense you face a fine of $300-1,000. Along with that you have the possibility of 10 days to twelve months in jail. Most judges will not require jail time for a guilty plea or verdict of guilty, but others will require some jail time. You may, however have to do a minimum of 40 hours of community service and face a one year license suspension.
Drunk Driving Second Offense
If you are charged with a DUI second offense you face a fine of $600-1,000 and jail time of three to twelve months. All but 48 hours of jail time can be suspended, stayed or probated. No matter what you will spend 48 hours in jail. You will also definitely be given no less than 80 hours of community service and a three year license suspension.
Drunk Driving Third Offense
If you are charged with a DUI second offense you face a fine of $1,000-5,000 and four to twelve months in jail. No matter what, you will spend ten days in jail. Along with your mandatory jail time, you will have to do at least 20 days of community service and you face a five year license revocation and declared as a “habitual violator”.
If you have three or more DUI convictions, a notice of conviction will be published in your local newspaper. This can be the cause of major embarrassment as the notice will include:
- your arrest photo
- your name and home address
- all details of the arrest
If you are convicted of DUI four or more times, your vehicle can be confiscated by the authorities. Its better be safe than sorry…the choice is yours!

It’s good to read a blog with some new info. on this. I keep reading the same rehashed material. Thanks for the informative post.
I did countless hours of research for attorneys to represent me and my case for my DUI. It was 5x harder then I expected but I finally found the right guys and they helped me wipe my record clean, I owe everything to them. They practically saved my children’s college fund!!
